Procurement Equalities Policy

1. Derbyshire Dales District Council recognises its responsibility and commitment to equalities in all its activities. . Any supplier/organisation working for and on behalf of the District Council, or any organisation receiving grants from the District Council, must comply with the Equality Act 2010 and the Council's Equality, Diversity and Inclusion Policy

2. The Procurement Act sets out a list of mandatory (Schedule 6 ) and discretionary (Schedule 7) exclusion grounds and places a duty on the District Council to consider both whether any of these apply to suppliers/organisations (including by virtue of a connected person), as well as whether the circumstances are continuing or likely to occur again. The District Council must exclude an excluded supplier/organisation and may exclude an excludable supplier/organisation from procurements.

3. As a condition of participation in a competitive tender procedure, bidding organisations will be required to answer the following questions:

  1. In the last three years, has your organisation had a complaint upheld following an investigation by the Equality and Human Rights Commission or its predecessors (or a comparable body in any jurisdiction other than the UK), on grounds or alleged unlawful discrimination? If ‘Yes’ please provide further details along with details of any changes made to prevent a repeat of enforcement/ remedial orders in future. Bidders who answer ‘Yes’ to this question may be subject to exclusion from the procurement process.
  2. In the last three years, has any finding of unlawful discrimination been made against your organisation by an Employment Tribunal, an Employment Appeal Tribunal or any other court (or in comparable proceedings in any jurisdiction other than the UK)? If 'Yes' please provide further details along with details of any changes made to prevent a repeat of enforcement/ remedial orders in future. Bidders who answer ‘Yes’ to this question may be subject to exclusion from this procurement process
