Brownfield Land Register

What is the Brownfield Land Register?

  • Since December 2017 the Council has been required by Government to have a Brownfield Land Register showing a list of previously developed sites that are available and potentially suitable for housing development across the District. Once in place the Register will be maintained and reviewed at least once a year to make sure it is up to date.

What is Brownfield Land?

Land which is or was occupied by a permanent structure, including the curtilage of the developed land (although it should not be assumed that the whole of the curtilage should be developed) and any associated fixed surface infrastructure. This excludes: land that is or has been occupied by agricultural or forestry buildings; land that has been developed for minerals extraction or waste disposal by landfill purposes where provision for restoration has been made through development control procedures; land in built-up areas such as private residential gardens, parks, recreation grounds and allotments; and land that was previously-developed but where the remains of the permanent structure or fixed surface structure have blended into the landscape in the process of time.

How are sites chosen?

Brownfield sites that meet the Government criteria The Town and Country Planning (Brownfield Land Register) Regulations 2017 are included in the Register.

The Government criteria states:

  • Brownfield land or previously developed land
  • More than 0.25 hectares
  • Suitable for five or more dwellings
  • Available for residential development
  • Achievable in the next 15 years
  • Allocated for housing in the Local Plan
  • Previously had planning consent – extant permission

Sites within the Peak District National Park

The Peak District National Park Authority is responsible for the Brownfield Land Register for sites that are in the Derbyshire Dales District but are within the Peak District National Park.

Brownfield Land Register (Part One) December 2024

Part One of the Register has all of the sites that we consider are suitable, available and achievable, and are greater than 0.25 hectare of brownfield land and have a capacity of five or more dwellings in line with the Brownfield Land Regulations criteria paragraph 4. Some are allocated in the Local Plan and some have the benefit of planning consent.

**Development at Middleton Road, Wirksworth, Land at Stancliffe Quarry Darley Dale, and Land at Middlepeak Quarry, Wirksworth and Halldale Quarry, Matlock are not recognised as not "deliverable" as defined by paragraph 5, Schedule 2 of the 2017 Brownfield Land Regulations as "there is no reasonable prospect that residential development will take place on the land within 5 years of the entry date".

Brownfield Land Register (Part Two)

Part Two of the register is optional and allows us to select sites from Part One and grant Permission in Principle (PiP) for housing led development. PiP will set out the principles of development in terms of the use, location and amount of development. However planning permission is not granted until Technical Details Consent is applied and approved by the Council.

We do not have any sites in Part Two though we may in the future, this is reviewed annually.
